Murder & Manslaughter

A murder charge is the most serious allegation a person can face in Canadian law. First-degree murder carries an automatic life sentence with no parole eligibility for 25 years. Second-degree murder brings life with parole eligibility of 10 to 25 years. The stakes could not be higher, and neither could the standard of defence required.

The Defence Must Start Immediately

Homicide investigations are long, complex, and often rely on forensic evidence, surveillance, cell tower data, and witness statements taken months or years before trial. The earlier a defence lawyer is involved, the more can be done, from pre-charge interactions with police to preliminary inquiry to trial.

How I Approach a Homicide File

I review every page of disclosure, often thousands. I retain the right experts (pathologists, toxicologists, digital forensics specialists) to test the Crown’s theory. I look at self-defence, the reliability of eyewitness identification, and the possibility of reducing the charge from first-degree to second-degree, or from second-degree to manslaughter.

Jury preparation, voir dires on admissibility, and careful cross-examination of the Crown’s experts are where cases are won.

What to Do If You Are Under Investigation

Say nothing to the police. Ask for a lawyer. Call me. Whatever you say, or don’t say, can shape the case for years and change your life forever.
