A theft, fraud, or mischief conviction may not carry the jail sentence of a violent offence, but the consequences can follow you in ways that are just as serious: lost employment, denied travel visas, professional discipline, and a criminal record that shows up on every background check. Theft under $5,000, theft over $5,000, shoplifting, fraud under and over $5,000, identity theft, breach of trust, mischief to property, and possession of stolen property. These offences share a common thread: they are almost always resolvable without a trial if handled well from the start.
I regularly negotiate diversion (charitable donations, community service, counselling) in exchange for charge withdrawal. Where diversion is not available, absolute and conditional discharges keep the conviction off your record. These resolutions require early, credible work with the Crown.
Sometimes the Crown’s case is weaker than it looks. Video that does not show the alleged act. Witnesses who cannot identify you. Items that were never actually stolen. I am ready to run a trial whenever the evidence supports it.
